1. A minimum charge of KES 1,856/- will apply;
2. All work carried out shall be paid by the customer to ODC in cash upon collection of the said equipment unless otherwise by prior arrangement / credit facilities. ODC has the right to demand a pre-payment or deposit of a pre-agreed amount, but no less than 2,320/- for which a receipt will be issued.
3. ODC shall have general lien on equipment for any moneys owing to ODC by the customer;
4. Equipment is housed by ODC at customer’s risk. ODC shall not be held responsible for any loss / damage / theft whatsoever. The customer is advised to insure equipment against such risks;
5. All efforts will be made to maintain software settings, however, ODC shall not be held liable for changes and/or loss of data;
6. All / any software on a computer is assumed to be legal and ODC shall not be held responsible for loss / damage / piracy;
7. Warranty jobs can take a minimum 2 working days and a maximum of 50 working days to process. ODC has no obligation to make any special conditions within the specified time period;
8. ODC has no obligation to provide for replacements while equipment is under repair;
9. ODC has no obligation to collect or deliver equipment, unless by special arrangement;
10. Consumables such as cartridges, optical media, batteries may need replacement on specific equipment while in repair. These costs shall be bourne by the customer;
11. ODC may cancel all or any part of the work to be done if it is prevented by reasons of strike, riot, accident, fire, earthquake, war, Government restrictions, licences, quotas, exchange control restrictions or any other circumstances beyond the control of ODC;
12. If any repairs remain incomplete due to non-availability of parts, ODC shall nevertheless be entitled to be paid for the work done and parts supplied or fixed;
13. ODC will return to customer all faulty / old items;
14. Electronic repair jobs may lead to a negative result; i.e. after working on the various internal electronic components, the device may be deemed unusable due to consequential failure originating from the original fault and the attempted repair;
15. In the event that repaired equipment is not collected within 24 hours of ODC notice of collection, ODC shall be entitled to make a reasonable charge for storage;
16. In the event that the customer is dissatisfied with the quality of repairs, maintenance, service or fitting of any parts or accessories carried out by ODC, the customer shall notify ODC in writing within 7 days. After the specified time, ODC shall not be liable to entertain any complaints of any nature whatsoever. Whilst every complaint brought to the notice of ODC within the said time will be investigated, nothing herein contained shall be construed as an admission of liability by ODC in respect of any such complaint;
17. Confidentiality. It is of no interest to any agent / engineer / technician of ODC to view the data contents of a given device. Repair of software will involve operating system and other installed programs, unless specified by customer. In summary, a customer is assured of complete privacy; no data will be viewed, forwarded, or used in any manner for whatever purpose.
18. All parts replaced carry a manufacturers’ warranty. This may be 3/6/12 months. Workmanship is guaranteed for 3 months;
19. Repeat job. In case a repaired (specific) device fails within 3 months, the job will be considered “repeat”. Exclusions include software corruption, virus infection, secondary failures and power related issues.
